Background:
On November 2, 1987, Council passed Demolition Control By-law 9198 that designated the Howard-Erie Neighbourhood Improvement Programme Area, as a Demolition Control Area, in which the subject property, 1155-1157 McDougall Street, is located.
On September 28, 2009 Windsor City Council denied the request to issue a demolition permit for the subject property (CR316/2009)
On November 28, 2011 the Building Department received another application from the applicant to demolish the same house at 1155-1157 McDougall Street. On January 16 th , 2012 deferred the application for demolition to allow Planning and Building Department staff to work with the applicant to identify possible solutions. Since Council’s deferral it appears that interior and exterior renovations were made to the property so that it could once again be occupied as a dwelling unit.
On September 29 th , 2020 the Building Division recieved an application for a Building Permit for Demolition from the applicant (Anthony Villegas) on behalf of the owner (Glenda Villegas) for the demolition of the property located at 1155-1157 McDougall Street (see Appendi x ‘A’ ), for the purpose of constructing a semi-detached dwelling (includes two (2) primary units) with a total of four (4) Additional Dwelling Units (ADU) to facilitate the redevelopment of the property. The Building Permit application is on hold because the subject properties are located within the Howard-Erie Neighbourhood Demolition Control area (By-law 9198).
Discussion:
Subsequently, the Applicant, has provided elevation, floor plan and site plan drawings to construct a semi-detached dwelling (includes two (2) primary units) with a total of four (4) Additional Dwelling Units (ADU) to facilitate the redevelopment of the property. One (1) ADU will be located in the basement of each primary semi-detached dwelling unit with one (1) ADU located at the rear of the property above each garage. (See Appendix ‘B’).
The existing (1) storey two (1) unit detached dwelling located at 1155-1157 McDougall Street is currently vacant according to the owner but appears to be in good condition according to records identified in EIS and Google Street View 2018.
Exemption from Demolition Control By-law 9198
Section 3 of the Demolition Control By-Law 9198 states that “...no person shall demolish the whole or any part of any residential property in the control area descried in Section 2 hereof unless the person is the holder of a demolition permit issued by the Council.” The decision to issue (or not to issue) a demolition permit is at City Council’s sole discretion.
