demolished.” Section 6 states that a demolition permit may be issued with the following conditions:

  1. That the applicant for the demolition permit construct and substantially complete the new building to be erected on the site of the residential property to be demolished by not later than such date as may be determined by Council, provided, however, that such date is not less than two years from the day demolition of the existing residential property is commenced;

  2. That, on failure to complete the new building within the time specified in the permit issued under Section 5, the Clerk shall be entitled to enter on the collectors roll, to be collected in like manner as municipal taxes, such sum of money as may be determined by Council but not in any case to exceed the sum of Twenty Thousand Dollars ($20,000.00) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued, and such sum shall, until payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.

Section 11.11 of the City’s Official Plan requires t he filing of redevelopment plan as a condition of approval for a demolition permit for areas subject to Demolition Control By-Laws.

Section 11.11.1.2 requires that Redevelopment plans shall include plans for:

  1. Replacement Buildings;

  2. Replacement of Demolished dwelling units and;

  3. Landscaped open space.

The applicant has indicated in their application that they intend to construct a semi-detached dwelling (includes two (2) primary units) with a total of four (4) ADUs to facilitate the redevelopment of the property. Each dwelling unit is permitted to have one (1) ADU within the existing dwelling unit and one (1) ADU that is separate from the primary dwelling unit. The Interim Control By-law 103-2020 does not apply to semi-detached dwellings and ADUs are exmept from the By-law.

The property is zoned RD2.2 which permits residential uses up to four dwelling units maximum; however, the ADUs are permitted in addtion to the zoning maximum.

The application and drawings are consistent with the requirements of Sections 11.11 regarding a Redevelopment Plan.

Section 6.3.2.5 of the Official Plan provides the following evaluation criteria for a proposed residential development within an existing neighbourhood development pattern.

“ At the time of submission, the proponent shall demonstrate to the satisfaction of the Municipality that a proposed residential development within an area having a Neighbourhood development pattern is:
