Zoning By-law Amendment Process

The intent of the zoning by-law is to provide standards and regulations for development in the City of Windsor, regulating use of land, buildings and other structures.

A zoning by-law amendment must conform to the Official Plan and shall consider relevant provincial legislation, policies, and appropriate guidelines, such as the Provincial Policy Statement, 2020.

The intent of the zoning by-law amendment approval process is to determine whether the proposed land use is consistent with the policies outlined in the Official Plan, and the Provincial Policy Statement, 2020.

The City of Windsor zoning By-law amendment process is as follows:

Planning staff in the Planning & Building Services Department prepare a report to the Development & Heritage Standing Committee (DHSC);

The proposed amendment is considered at the monthly DHSC meeting where committee members make recommendation to Council;

The recommendations together with the planning staff report are forwarded to Council for final decision; and

The decision of Council may be appealed to Local Planning Appeal Tribunal (LPAT).

The proposed zoning by-law amendment is at the “DHSC meeting” stage where the committee must make recommendation to council as to whether the proposed land use is appropriate for the subject site with respect to the Official Plan and Provincial Policy Statement, 2020.

The site plan control approval process is separate to the zoning by-law amendment process. The site plan control approval process examines the sites design and functionality.
