could be subject to a fifty (50) dollar Administrative Penalty. The suspected contravening vehicles are brought to the attention of the enforcement contractor through neighbourhood related complaints. At no time are these vehicles sought out by the Parking Enforcement contractor without a complaint first being lodged.
While researching this request, administration has found that the 3,000 kg threshold is being breached by a large number of passenger vehicles that are being purchased in today’s market, and parked in front of residences throughout the City daily. After surveying a number of similar Municipalities throughout the Province, a new upper limit GVWR of 4,500 kgs is now being implemented and recommended. As this new number still does not address the issue at hand, a new addition to the bylaw, section 10(9) listed below, is also recommended at this time.
10(9) Sections 10(3) and 10(4) above do not apply to the following vehicles which are parked or stopped on any highway at anytime within the City of Windsor:

Marked vehicles actually engaged in works or on call, undertaken for or on behalf of The Corporation of the City of Windsor or a public utility, including utilities providing hydro, telephone, natural gas or internet service.
Due to the nature, and expected response times needed to cover emergency situations, and Commercial vehicle driving restrictions, a larger number of these “On Call” employees are needed from time to time. Meaning, an employee who is scheduled to be “On Call” one after hours evening, may have already reached his/her maximum hours worked for a 24 hour period, so an unexpected employee will have to fill this time slot. This would lead to a greater number of vehicles parked at staff members residences.
Risk Analysis:
If the above noted recommendation to add section 10(9) is not passed by Council, ON Call Public Utility vehicles will have to be parked at their respective work locations which in most cases will increase response times for called upon emergency procedures by Windsor Fire and Rescue and or Windsor Police Services.
Also if the GVWR increase of 1,500 kgs. is not accepted by Council, Windsor residents could face Administrative Penalties for parking their family vehicle on City of Windsor right of ways.
