10(9) Sections 10(3) and 10(4) above do not apply to the following vehicles which are parked or stopped on any highway at anytime within the City of Windsor:

Background:
On May 27, 2019 the following Council Directive was issued:
“That the correspondence from Enbridge Gas Inc. dated May 8, 2019 regarding “Emergency Response – Enbridge Gas Vehic les” BE RECEIVED for information; and further, That Administration BE DIRECTED to prepare a report for Council’s consideration on this request, and that enforcement of the applicable by - law BE STOOD DOWN until Council considers the report.”
On October 3, 2018 a complaint was lodged through the City of Windsor’s Parking Enforcement contractor, The Commissionaires’ dispatch line, to attend a Windsor residence for a large vehicle parked on the roadway. When the officer attended, a Union Gas service truck was parked on the right of way, and assuming that the vehicle was over the 3,000 kg threshold, a penalty was issued. The complaints continued and it was discovered that there are two (2) Union Gas field technicians living in the same residence both having their respective service vehicle parked
In order to avoid the infractions that were being laid now on both vehicles, the employees took to parking the vehicles in their own driveway. The complaints continued but were now sent to the Building Department for commercial vehicles parked on private property. In numerous emails between all parties involved, the Building Dept. determined that this was against the Zoning Bylaw and Union Gas was put on notice.
Windsor Fire and Rescue was advised by Union Gas that its response times would be diminished greatly if service vehicles were not allowed to be brought home after normal working shifts to attend emergency calls. The City was advised that at any given time there are 5 field technicians “On Call” on evenings and weekends. Forty-five (45) employees in the region have the ability to take their assigned work vehicle home.
Discussion:
On the regular Council meeting of Monday May 27, 2019 a communication from Brian Lennie of Enbridge Gas Inc. was presented and Administration was asked to look into the possibility of exempting Union Gas service vehicles from Sections 10(3) and 10(4) of the Parking bylaw #9023, referring to vehicles parked over a Gross Vehicle Weight Rating (GVWR) of 3,000 kilograms. In the current reading of the bylaw these vehicles, if parked on a City of Windsor street not listed in schedule AA, Designated Truck Routes,
