The laneway, which according to the site plan is to be used by the residents of the four plex is way below the bare minimum of the width of a road acceptable by by-laws. The size of the laneway in the site plans does not account for the hazards already on the lane way including hydro poles, which take at least another foot away from the width of the lane way. (please see photo 4 in the appendix).

The builder’s original plan was to put six parking spaces with one for handicap, which is required by the by-laws. The site plan produced to the committee included four, this was likely due to the fact that six spaces mathematically was not possible on the lot size and two, if there were six spaces the width of the spaces would have to be per the parking lot code, but four spaces does not meet the definition of a parking lot and therefore the size of the spaces do not need to meet the same code.

These issues have been raised and in return we have been told that if a person is not properly parked, we can simply call 311 each time. This makes no sense. Why would the City of Windsor approve parking and plans, if the plans go against the laws? You are setting the residents, that use this space, up for numerous tickets. They eventually will have no choice but to not use the parking spaces that the City approved and park on the road that is already congested and a hazard. (Please see photo 5 in the appendix). The parking plans are setting up the residents of this new complex and those that back onto this property for numerous insurance claims for both automobiles and property.

According to the plans, the new owner is to pave a potion of the lane, to set standards. What is not addressed is who will maintain this section for upkeep, snow removal etc? Who will own this portion of the lane – the new owner or the city? If the new owner takes possession, the neighbours want to know why they were not offered their half of the laneway for purchase, something they have wanted for years?
