- Carving Copyright
- In the simplest terms, "copyright" means "the right to copy." In general, copyright means the sole right to produce or reproduce a work or a substantial part of it in any form. It includes the right to perform the work or any substantial part of it or, in the case of a lecture, to deliver it. If the work is unpublished, copyright includes the right to publish the work or any substantial part of it.

- Copyright applies to all original literary, dramatic, musical and artistic works provided the conditions set out in the Copyright Act have been met. Each of these general categories covers a wide range of creations, including:

- • literary works: books, pamphlets, computer programs and other works consisting of text;
- • dramatic works: motion picture films, plays, screenplays, scripts, etc.;
- • musical works: musical compositions with or without words; and
- • Artistic works: paintings, drawings, maps, photographs, sculptures, plans, etc.

- Any original literary, dramatic, musical or artistic work is automatically protected by copyright the moment it's created. The work's creator is usually held to be the copyright owner. However, an employer has copyright for works created by employees unless thet·e is an agreement to the contraty.

- When you own copyright on a work you can control how it's used. Others who want to use the work have to buy or otherwise get your permission. You can limit use to protect the value of the copyrighted work.

- Copyright in Canada generally exists for the life of the author plus 50 years following death. After that, the work becomes part of the public domain and anyone can use it. However, there are exceptions to that as well.

- Rusty Barton, as the Artist, owns all copyrights to this carving. You may not make commercial advertising or promotional materials, depicting or showing images of this carving, without written consent and a signed commercial use contract.

- If you sell the prope1ty that this carving is sitting on, you should hand this paperwork over as well. The new owner should be advised in the proper care of this carving, our warranty and maintenance programs and they must be informed of this carvings copyright contract, which they are bound to.

- If you cut this carving from the ground or remove it, you must infotm Rusty Barton of the actions to be taken. If the carving is sold after removal, you should hand this paperwork over as well, for the same reasons as above.

- If an identity would like to use this carving for commercial use, a Commercial Use Contract must be signed and accompany this contract. The Commercial Use Contract will specify the length of time used and the breadth of the campaign and a percentage will be paid for use of the copy rights for that period of time.
