Background:

At the January 22, 2020 meeting of the Environment, Transportation and Public Safety Standing Committee, the Committee received report S 236/2019 Electric Kick-Scooter Pilot. This report was provided in response to a pilot program under the Highway Traffic Act to allow electric kick-scooters (e-scooters) on roads in Ontario, subject to the bylaws of the municipalities having jurisdiction over the road. The report recommended amendments to Traffic By-law 9148 to permit electric kick-scooters on City of Windsor streets, subject to certain conditions, including a requirement for all riders to wear helmets.

The requirement for all riders regardless of age to wear helmets goes beyond the minimum requirement of the Highway Traffic Act pilot, which requires helmets only for riders under 18 years old.

The Highway Traffic Act pilot prohibits riders under 16 years old from riding electric kickscooters in the right-of-way.

At the meeting, the Committee recommended that the recommendations of the Administration report be adopted with the following modifications:
