Conclusion:

Approving the exemption is premature in that it may allow a use - a Transport Terminal - that is not compatible with sensitive land uses to the west. However, the subject parcel is adjacent to a rail corridor and the Windsor International Airport, which is in keeping with the current and proposed policies in the City of Windsor Official Plan. It is also a large parcel, which provides an opportunity to separate the proposed transport terminal from the sensitive land uses through a berm.

It may be several months before approval and implementation of the Actions identified in the Transport Terminal Land Use Study are in force, more if an appeal is filed. Approval of the exemption will allow for much needed improvements to the parcel, especially along Division Road and the west lot line, to proceed separate of the Transport Terminal Land Use Study. Approval will also allow the applicant to prepare required reports and studies and will allow Administration to process a site plan application for a Transport Terminal on the subject parcel.

The recommendation includes additional direction to the Site Plan Approval Officer in terms of incorporating any mitigation measures identified in a noise study and the provision of a setback and berm along the west lot line.
