A BY-LAW TO FURTHER AMEND BY-LAW NUMBER 8600 CITED AS THE "CITY OF WINDSOR ZONING BY-LAW" Passed the day of , 2020.

WHEREAS it is deemed expedient to further amend By-law Number 8600 of the Council of The Corporation of the City of Windsor, cited as the "City of Windsor Zoning By-law" passed the 31st day of March, 1986, as heretofore amended:

THEREFORE the Council of The Corporation of the City of Windsor enacts as follows:

  1. That subsection 1 of Section 20, of said by-law, is amended by adding the following paragraph:

    400. S OUTH S IDE OF U NIVERSITY A VENUE W EST , W EST OF W ELLINGTON A VENUE

    For the lands comprising of W PT Lot 1 ROW; Over S PT Lot 9, Registered Plan 683:

    1. A dwelling unit on the main floor and/or in the basement shall be an additional permitted use and, that for the additional permitted use, no additional amenity area and no additional parking space are required.

    2. Number of Dwelling Units – maximum – 8

  2. The said by-law is further amended by changing the Zoning District Maps or parts thereof referred to in Section 1, of said by-law and made part thereof, so that the lands described in Column 3 are delineated by a broken line and further identified by the zoning symbol shown in Column 5:

3. That the lands affected be subject to a H symbol and that the H symbol be removed when the following conditions have been satisfied:

  1. The owner submits an application to remove the H symbol;

  2. (a) Encroachment Agreement

    The owner submits an application for and execute an agreement with the Corporation for the proposed encroachments into the right-of-way (i.e. private drain connection) to the satisfaction of the City Engineer.

    (b) Existing Sewers and Connections

    The owner further agrees, at its entire expense and to the satisfaction of the City Engineer:

    1. To undertake a video inspection of the mainline sewers that will be used by the subject property and all connections to the mainline sewers that service the subject property.

    2. Any redundant connections will be abandoned according to the City of Windsor Engineering Best Practice B.P.1.3.3.

    3. Any new connections to combined sewers will follow City of Windsor Engineering Best Practice B.P.1.1.1.
