4.0 ZONING BY-LAW REGULATIONS 1-2014

The subject lands are zoned ‘Commercial District 2.1 (CD2.1)’ and ‘Residential District (RD2.1)’ in the Comprehensive Zoning By-law 8600 for the City of Windsor.

COMMENT:

  1. Section 15.1.1 (CD2.1) does not permit residential use. The ZBA establish a regulatory framework for the development of the site for a medium profile residential apartment building;
  2. Section 11.1.1 (RD2.1) does not permit multiple residential buildings;
  3. Section 24.6 Parking requires 1.25 spaces/unit at 28 units requires 35 parking spaces. Parking relief has been requested to permit 28 spaces, 1 space per unit. Compensatory bike racks are proposed at 15 bike spaces;
  4. Section 24.24.1 Barrier Free Parking requires 1 Type A and 1 Type B. 1 Type A and 1 Type B barrier free parking spaces have been provided on site;
  5. Interior Side yard – requires a minimum 6 m. Site specific provision is being requested to recognize 3.6 m interior side yard. The adjacent parcel with shared lot is the Redeemer Church with the building established with a significant separation distance. There will be no negative impact on the adjacent land use with the relief for the interior side yard being requested.
