The Board finds no dispute either.
As for the nine-metre setback along North Talbot Road to accommodate the non-existent storm sewer, it was not only the unanimous view of the expert witnesses that it was unnecessary for its original purpose, but also that this large setback may be visually undesirable, because it might lead to a “sea of cars”. The Board finds no dispute on that account either. The attached Schedule 1 reflects this modification.
CONCLUSION
THE BOARD ORDERS that the appeal is allowed in part. Zoning By-law 8600 of the City of Windsor is amended, in accordance with Schedule 1 of this Order.
The Board authorizes the City Clerk to assign a number to this By-law amendment for record-keeping purposes.
