The applicant has since made changes to their development proposal and are requesting that City of Windsor staff consider amendments to the initial application. The latest development proposal intends to develop the site for:

an 855 m² (9,200 ft²) building (1200 University Avenue West) for office uses;

an 822 m² (9,500 ft²) building (1220 University Avenue West) for commercial uses;
-
a five (5) storey, 1,843 m² (19,838 ft²) one hundred and thirty-three (133) unit multiple dwelling building, and
-
a 470m² (5,060 ft²) amenity building.
The proposed residential building will have two (2) levels of parking (108 spaces) below the residential units. The intent of the new development proposal is to include additional parking for both the residential and commercial buildings.
Additionally, the applicant is in the process of making application to sever the residential portion of the site from the commercial. The intent of the severance provides the applicant with more flexibility with respect to the future sale of the residential and commercial properties separately. As such there are additional zoning provisions required to accommodate the newly proposed development, specifically, a property line for the residential building (no street frontage, parking on an adjacent lot, and parking within 0m of an interior lot line and a habitable room window).
The proposed site plan is provided as Figure 1.
As such, the applicant is requesting that the proposed site specific CD2.2 zoning include the following provisions (changes from original application shown in bold):

Permits a multiple dwelling;

Provides relief from provision 5.2.10 to permit a building on a lot with no street frontage;

Provides relief from provision 5.2.20.1 to permit 53 dwelling units with a minimum gross floor area of 31m²;

Provides relief from provision 15.2.5.4 increasing the permitted maximum building height from 14m to 19m;

Provides relief from provision 15.2.5.9 decreasing minimum amenity area per dwelling unit from 12m² to 10m², and permits amenity area on an adjacent lot;

Provides relief from provision 24.20.5.1 to permit one parking space per residential unit;
-
Provides relief from provision 24.22.1.1 to permit no visitor parking for a multiple dwelling;
-
Provides relief from provision 24.26.1 to permit locating multiple dwelling parking spaces on an adjacent lot;
-
Provides relief from provision 25.5.20.1.3 & 25.5.20.1.6 to permit parking areas within 0m of an interior lot line & 0m of a habitable room window; and
