Conclusion:
The application has been processed and evaluated with regard to both The Planning Act and The Condominium Act, as well as the City of Windsor Official Plan, and is in conformity with the zoning regulations and the City of Windsor Official Plan. Municipal requirements regarding this development have been addressed through the conversion to condominium tenure.
It is recommended that this application for approval be exempted from Section 51 of The Planning Act (per Section 9(3) of The Condominium Act). This means that the owner can proceed directly to registration following submission of an approved final plan of condominium.
