BY-LAW NUMBER 133-2020

A BY-LAW TO CLOSE, STOP UP AND CONVEY THE 4.27 METRE NORTH/SOUTH ALLEY LOCATED SOUTH OF SYDNEY AVENUE, NORTH OF SEYMOUR BOULEVARD, WEST OF WALKER ROAD AND EAST OF TURNER ROAD, CITY OF WINDSOR 

Passed the 28th day of September, 2020.

WHEREAS it is deemed expedient to close, stop up and convey the 4.27 metre north/south alley located south of Sydney Avenue, north of Seymour Boulevard, west of Walker Road and east of Turner Road, City of Windsor, more particularly described in Schedule "A" attached hereto;

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. That the 4.27 metre north/south alley located south of Sydney Avenue, north of Seymour Boulevard, west of Walker Road and east of Turner Road, City of Windsor, more particularly described in Schedule “A” attached hereto and forming part of this by-law, be and the same is hereby closed and stopped up.

2. That the full 4.27 metre width of the closed alley be first offered for purchase to the owners of the properties municipally known as 3253 Walker Road and 3295 Walker Road and zoned commercially as CD3.3. If the said owners of 3253 Walker Road and 3295 Walker Road do not wish to purchase the closed alley then the parcels be offered for purchase by the owners of the abutting properties on Turner Road residentially zoned as RD1.1.

3. That the conveyance cost of the closed alley shall be set as follows:

  1. For alleys abutting lands zoned CD3.3, $12.00 per square foot without easements, and $6.00 per square foot with easements; and

  2. For alleys abutting lands zoned RD1.1, $1.00 plus deed preparation fee and proportionate share of the survey costs as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.

4. That any required easements pursuant to Council Resolution CR507/2019 be registered prior to conveyance.

5. That the Chief Administrative Officer and City Clerk be authorized and directed to execute on behalf of The Corporation of the City of Windsor and to seal with the seal thereof, any and all documents necessary to implement the foregoing; and that the transaction be completed electronically, for property where it is available, pursuant to By-law Number 366-2003, as amended from time to time.
