The updates made are primarily to the technical definitions to improve upon the success of enforcement measures including “Contravener”, “Culvert”, “Infrastructure”, “Leadwalk”, “Permit Holder”, “Private Sewer Connection”, “Traffic Protection Plan”, and “Utility”. Additional amendments include:

• 2 Addition of "Artificial Turf" to boulevard restrictions and of exemptions for companies with Municipal Access Agreements.
• 5 Addition of responsibility for adjacent property owner to ensure clear open passage of water through culvert.
• 6 Retitle of "Private Connection" to "Private Water Connection"
• 8 Additional wording allowing the City to tow a parked vehicle that is polluting
• 10 Improvement of Insurance coverage to $5 million. Addition of requirement to supply additional documentation to support permit requirements on request. Simplification of permit validity process. Clarity with respect to emergency work permit requirements.
• 12 Clarity with respect to assigning responsibility for contravention of By-law to the property holder adjacent to the location of the contravention.

In addition, the definitions of “Good Standing” and “Private Sewer Connection” were updated for By-law 4921.

If approved, the amended By-law would be presented for adoption by City Council.

Risk Analysis:

There are no critical or significant risks associated with the recommendations in this report. There is low risk anticipated with respect to the proposed changes and the more specific wording is expected to lessen risks inherent with enforcement.
