Windsor Police SPEED LIMIT While Toronto’s guidelines indicate only allowing these on roadways with posted and operating speeds of 40 km/hour or less, I think that will be very restrictive in Windsor where there are not very many roadways with posted speeds that low. I do however think these special roadway patios should be restricted to be along roadways of 50 km/hour or less.
UNOBSTRUCTED EMERGENCY RESPONSE It is very important that whatever patio layout an individual property owner puts into place maintains unobstructed emergency police response capability as required.
RAILINGS SUROUNDING PARKLET Regardless of the AGCO relaxing the requirement for railings around the café boundary due to COVID‐19, there remains a strong public safety case for having such railings. This is because, unlike conventional outdoor patio spaces, these “Parklet Cafes” are much closer to moving vehicular traffic and are in fact contiguous to lanes of moving vehicular traffic. This presents an increased safety risk if a vehicle was to lose control and crash into the patio – the consequences are predictably significant. If the installation of a full railing enclosure is deemed too onerous, a possible compromise would be, at minimum, to provide some tangible protective barrier at the front end of the patio space that immediately faces oncoming traffic. Such protection would help safeguard café patrons in an areamost vulnerable to inherent safety risks.
RAILING HEIGHT I feel the minimum height of any railing enclosure or section thereof should be 42” to safely prevent an individual within the patio from accidently losing their balance and falling into the adjacent roadway. I realize Toronto’s guidelines call for a 36” minimum but my professional opinion is that this height is not quite enough. Any barrier/railing needs to allow visibility through it – itmust not be opaque.
SIDEWALK WIDTH There needs to be an adequate width of public sidewalk maintained between the building façade and the curb edge where the parklet café begins to allow safe travel by passing pedestrians. Our
