Preparation of the Engineer’s Report under Section 78 of the Drainage Act allows for the implementation of any Drainage Improvements necessary to facilitate required improvements. The designation permits the trespassing of private property. The report will also address the needs for, and access for, future maintenance of this section of drain.

The proposed appointment of Dillon Consulting Limited as the Drainage Engineer by Council Resolution will satisfy the requirements of the Drainage Act.

Council Resolutions CR388/2007 and CR64/2015 confirm that the municipality would absorb all drain maintenance costs through the general tax levy.

Risk Analysis:

There is limited risk associated with this recommendation. The work to be completed has been previously funded through the Provincial/Division Corridor Improvements Phase 2 Capital Project. Appointment of Dillon Consulting Ltd. as Drainage Engineer would ensure that the work is carried out in accordance with the provisions of the Drainage Act.

Financial Matters:

The projected cost of $15,000, plus applicable HST will be funded through the existing Sixth Concession -– Provincial/Division Corridor Road Improvements (Project ID 7086003).

Administration recommends that City Council appoint Dillon Consulting Limited as Drainage Engineer to make an examination of and prepare a Drainage Report for improvements to the 6th Concession Drain in accordance with Section 78 of the Drainage Act.
