For allowing alcohol consumption in public parks
The risk associated with alcohol consumption in public parks is well managed by existing policies and procedures for outdoor special events. Liability insurance requirements in standard agreements protect the City’s interests, and special events agreements have already been updated to include language requiring compliance with EMPCA orders.
Significant risks must be evaluated should Council choose to consider allowing alcohol consumption in parks outside of licenced events, including but not limited to:
Increased frequency of property damage and liability costs
Potential for reduced usage by a broad range of residents, particularly parents with children, due to concerns about intoxicated people in parks
Expanded responsibilities and costs associated with policing and enforcement
Potential for increased public health risk, as unmanaged consumption in open spaces may encourage closer interaction between park users and less adherence to social distancing requirements.
For post-facto inspections
The inspection processes currently used by City staff is very effective at ensuring compliance with requirements of liquor licencing, stewarding public safety and confidence Windsor’s built environment. Adopting post-facto inspections would undermine these processes and deny inspectors a vital tool for making sure permit applicants fulfil the terms of their request. If inspectors cannot withhold authorization for continuing construction processes, especially occupancy, City staffs’ ability to ensure Building Code and Fire Code compliance would be significantly reduced and public safety placed at risk. The City may also expose itself to risk by performing post-facto inspections without receiving support from Provincial officials.
