The house that I am planning to build will be located within an un-serviced rural farmland area located at 4689 County Road 17 Concession 10 located outside of the County Road 42 Secondary Plan land use area. (Please refer to attachment for 4689 County Rd. 17 building lot location). The lot is located approximately 1.2 kilometers south of Baseline road. There are currently no city storm and sanitary sewers available along County Road 17. Information obtained from the City of Windsor's website show that this property is currently zoned agricultural and refers to Section 15 of Town of Tecumseh zoning By-Law 85-15. Currently the lot is being farmed and will be contributing to the City of Windsor $28.00 tax revenue for the year 2020. As a result of our home being built the City of Windsor will be impacted with an increased tax revenue of approximately $6,000 - $7,000 per year.
We began the building planning process in August 2019. My father and I contacted Ward 9 Councilor Kieran McKenzie after we were made aware by the City of Windsor Building Department of the DC cost amount that would be payable as part of the building permit fee. We had numerous conversations via cell phone and one meeting with Councilor McKenzie as we started to discuss the possibility of a reduction of the development charge cost. Since there are no sanitary sewers available for me to connect to there would be an additional cost for me to purchase and install to provide my own on-site private septic water system is approximately cost of $25,000 in addition to the DC cost amount. We also requested his advice regarding the process to address applicable City of Windsor Departments and City Council regarding this issue. Since that time my father has been in contact via telephone with City Staff of Planning, Engineering, Building and Finance Departments and all have conveyed the same message that City Council voted to approve Developmental Charges and only City Council has the authority to decide on any possible amendment.
My father was informed by Mark Winterton of the Engineering Department that when the area I plan to build in becomes developed and city services, such as sanitary sewer are provided, I would then need to connect to the sanitary sewers. At that time an additional by-in fee will be imposed to me that will result in additional costs to me that could be in the tens of thousands of dollars based on the frontage of my property.
The purpose of this letter is that the members of City Council consider a 'fair' reduction of the 2019 $42, 951 development charge amount to help offset cost to develop my own on-site septic system and future by-in fees. The majority of the Sandwich South Planning District is currently 'rural' farmed agricultural land and DC By-Law 60-2015 does not have a 'rural' category. Municipalities neighboring the City of Windsor all have 'rural' categories contained with their 2019 Development Charge By-Laws for single unit dwellings:
