Background:

On January 24, 2020, Gagnon Demolition Inc., on behalf of CK Mechanical Heating & Cooling Inc. applied for an exemption under Demolition Control By-law 20-2007 to demolish the existing two (2) storey single unit detached dwelling located at 3842 Peter Street for the expansion of the existing industrial use (CK Mechanical Heating & Cooling Inc.) located at 3846 Peter Street south (adjacent) the subject property (3842 Peter Street). See Appendix 'A' for the location map.

The property was the subject of an amendment to Zoning By-law 8600 approved by City Council on April 15, 2019, to change the zoning of the properties located at 3842 and 3846 Peter Street from Development Reserve District 1.1 (DRD1.1) to Manufacturing District 1.2 (MD1.2) and Manufacturing District 1.4 (MD1.4) to allow the expansion of the contractor's office and to improve the usability of the parcels in the future.

The improvements were also subject to Site Plan Review and a Si te Plan Control Application and Drawings were approved on October 24, 2019 (See Appendix 'B'), and the site plan control agreement has been registered. The securities required by this agreement have not yet been submitted.

Discussion:

Exemption to Demolition Control By-law 20-2007

The existing two (2) storey single unit detached dwelling located at 3842 Peter Street is currently in good condition. The applicant is requesting demolition of the existing structure for the expansion of the existing CK Mechanical Heating & Cooling Inc. facility located at 3846 Peter Street.

Section 3 of the Demolition Control By-law states that "...no person shall demolish the whole or any part of any residential property in the area of demolition control unless the person is the holder of a demolition permit issued by the council..." The decision to issue (or not issue) a demolition permit is at City Council's sole discretion.

Section 5 of the Demolition Control By-law states that "Council shall, on an application for a demolition permit, issue a demolition permit where a building permit has been issued to erect a new building on the site of the residential property to be demolished" Section 6 states that a demolition permit may be issued on the following conditions:

(a) That the applicant for the demolition permit construct and substantially complete the new building to be erected on the site of the residential property to be demolished by not later than such date as may be determined by Council, provided, however, that such date is not less than two years from the day demolition of the existing residential property is commenced;
