Discussion:

Festival organizers are committed to support and promote local businesses from Windsor and surrounding cities who can offer authentic Mexican food as well as Agave spirits. Festival activities and programming include a Lucha Libre show (wrestlers), Mariachi performers, Aztec dancers and a presentation of Latin music. Festival attendees will experience Mexican culture first hand and exciting cuisine along with Agave spirits.

The event organizer would be expected to enter into an agreement with the Corporation to the extent similar to the other festivals and events that currently are presented at City of Windsor facilities, including indemnifying the City of Windsor of any future legal, environmental, or financial liability associated with the event. The client must obtain and provide insurance in the amount of $5,000,000 (five million dollars) including a provision for Host/Liquor liability.

Consumption of alcohol within the festival site would occur at the event. The applicant would be required to adhere to the Municipal Alcohol Policy.

Risk Analysis:

All risks associated with the event have been vetted through the Special Events Resource Team (SERT) and other affected parties have been consulted where required.

Litigation risks are standard with any special event and pose a significant risk, but they will be managed by transferring risk to the Event Host by requiring the Event Host to provide an indemnification and proof of insurance. Insurance and all other conditions that must be satisfied for the event to proceed are handled in accordance with the Special Events Agreements Procedure.

Financial Matters:

All fees associated for this event are the responsibility of 11845217 Canada Corp. The applicant would be required to rent the venue and pay the applicable fees as per the 2020 Schedule of Fees.

The City of Windsor recognizes the importance of special events and festivals in enhancing the quality of life, tourism, culture, recreation and education, all of which would not be possible without the invaluable services of volunteers, community groups and sponsors that add their support and skills to enhancing the community events.
