Financial Matters:

For alleys abutting lands zoned CD2.1, $12.00 per square foot without easements and $6.00 per square foot with easements, plus deed preparation, plus proportionate survey costs as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.

Consultations:

Consultations were held with Municipal Departments and Utility Companies, which resulted in the information found in attached Appendix "C".

There were no objections from the municipal departments and utility companies for the requested alley closure; however, Public Works – Engineering notes that the existing hydro poles and guy wires will require an easement. The municipal storm and sanitary sewers in the alley will become private drain connections for 4200 Tecumseh Rd E as it only services their property.

Bell Canada and Enwin Utilities Ltd. have requested easements within the subject area of closure. These will be identified when the Reference Plan is prepared by the Ontario Land Surveyor.

Note that the required easements shall remain unencumbered in perpetuity by any building or other structure, but this shall not prevent the Transferor from paving and parking on the said lands.

Notice of Development & Heritage Standing Committee meeting and Council meeting are published in the Windsor Star prior to each of the meetings. In addition, notice of each of the public meetings will be mailed to the abutting/affected property owners prior to the meetings.

Conclusion:

The Planning Division recommends closure of the portion of the east/west alley shown on attached Appendix "A", subject to easements as in Recommendation II of this report, in favour of Bell Canada and Enwin Utilities Ltd.

The closed alley is to be conveyed to the abutting property owner as specified in Recommendations II and III of this report.
