Background
Because there is an existing road but no standard sewage collection and transmission to this block, the construction of a sanitary sewer would qualify as a Local Improvement Work under the provisions of Ontario Regulation (O. Reg.) 586/06.
Discussion
Construction of sanitary sewers on roadways where residents and businesses are utilizing septic tanks has been a long-standing goal of the City. Septic tanks pollute watercourses by delivering health endangering contaminants through overflows to storm systems.
The project scope of the local improvement is limited to installation of a new sanitary sewer and private drain connections, however EnWin-Water has expressed interest in completing the rehabilitation of the existing watermain at their costs in spirit of efficiency of work. EnWin-Water will reimburse the City the cost of the watermain portion of the work plus an administrative fee for the City's portion of engineering and contract administration related to the watermain. This will partially offset the net cost to the City for the overall works. The Financial Matters section of this report provides further detail.
Under Section 8 of O. Reg. 586/06, the municipality may apply to the LPAT for approval to undertake a work as a local improvement. If within 30 days after the required notices with respect to the construction of sanitary sewers are given, and no objections to the work being undertaken are filed under this Section, the municipality is deemed to have received LPAT's approval. If an objection with the reasons in support of them is filed with the Clerk under Section 8 of O. Reg. 586/06, the City shall forward the objection to the Board, together with the application as soon as is reasonably possible , for a hearing.
Section 6 of O. Reg. 586/06 states that before passing a by-law to undertake a work as a local improvement, the municipality shall give notice of its intention to pass the by-law, to the public and to the owners of the lots liable to be specially charged. Further, the section specifies the information which shall be included in this notice. This information is found in the attached report from the City Engineer. Note the special charges are assessed only for the local improvement works and not the watermain portion of the project.
The City of Windsor's Property Standards By-law 147-2011 states that all sewage shall be discharged directly into a municipal sewage system where one is available. Further, a property shall be deemed to be serviced by a sewer if the sewer is within 30.5 metres (100 feet) of any boundary line of the said property. Construction of a sanitary sewer on Baseline Road between 7th Concession Road and 8th Concession Road will result in the servicing of 65 properties.
