PROPOSAL :

The applicant is requesting to change the Zoning By-Law 8600 for the lands described as Parts 1, 6 & 7 , 12R-27363, from Green District 1.1 (GD1.1) to Residential District 2.3 (RD2.3).

BACKGROUND INFORMATION :

City Council in 2001, adopted CR291/2001 to approve

The zoning of the northerly half of the lands at the southeast corner of Pearson Avenue and Beverly Glen Street (being the northerly half of Lots 41 and 42 12M-515) was changed from PD.1 to OS.1 (Planned Development to Open Space). The Open Space zoning category later became Green District 1.1 (GD1.1) under the consolidated zoning by-law 8600. The subject GD1.1 parcel was one of the parcels identified for future parkland (tot lot) conveyance to the City.

Since the time that these approvals were granted, it has become more desirable, from a parks management and community service perspective, to create larger neighbourhood and community parks. The origina lly proposed ‘parkette’ at the location of Pearson and Beverly Glen is considered by today’s standards to be undersized and isolated, and therefore, less desirable. There is now a greater emphasis on consolidation of parklands for larger multi use and multi functional parks. This requested zoning amendment is a product of the new Council directive towards parkland consolidations in the City of Windsor.

On December 12, 2019, it was confirmed by the City’s Legal Department that the City has received the funds from 1027458 Ontario Inc. as payment in full and the City released its interest in these lands [the subject GD1.1 land(s)] which formed provision S-13 of the subdivision agreement registered as instrument number CE106861.
