BY-LAW NUMBER 169-2020

A BY-LAW TO CLOSE, STOP UP AND CONVEY THE 2.40 METRE NORTH/SOUTH ALLEY LOCATED SOUTH OF BROCK STREET, NORTH OF PRINCE ROAD, WEST OF BIRCH STREET AND EAST OF MULFORD COURT,

Passed the 21st day of December, 2020.

WHEREAS it is deemed expedient to close, stop up and convey the 2.40 metre north/south alley located south of Brock Street, north of Prince Road, west of Birch Street and east of Mulford Court, City of Windsor, more particularly described in Schedule "A" attached hereto;

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. That the 2.40 metre north/south alley located south of Brock Street, north of Prince Road, west of Birch Street and east of Mulford Court, City of Windsor, more particularly described in Schedule “A” attached hereto and forming part of this by-law, be and the same is hereby closed and stopped up.

2. That the conveyance cost of the closed alley abutting lands zoned RD1.2 be set at $1.00 plus deed preparation fee and proportionate share of the survey cost as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.

3. That any required easements pursuant to Council Resolution CR173/2019 be registered prior to conveyance.

4. That the Chief Administrative Officer and City Clerk be authorized and directed to execute on behalf of The Corporation of the City of Windsor and to seal with the seal thereof, any and all documents necessary to implement the foregoing; and that the transaction be completed electronically, for property where it is available, pursuant to By-law Number 366-2003, as amended from time to time.

5. This by-law shall come into force and take effect the day upon which it is registered in the Land Registry Office for the County of Essex (No. 12).
