Based on the above discussion, it is more appropriate to recommend against the requested closure of “Part 2” on Drawing No. CC-1751B. The portion of the requested closure shown as “Part 1” on Drawing No. CC-1751B is not required for access to the municipal sewer infrastructure and therefore can be deemed dispensible.

Risk Analysis:

The recommended closure is necessary to facilitate the sale of the subject land (area of closure), which will divest the City of associated liability risks and maintenance costs.

The Street and Alley Closing Policy (CR 130/2006) includes the following relevant criteria that shall be applied to determine the conveyance of the closed right of way:

For property abutting DRD1.1 conveyance price will be $10.76 per square metre without easements and $5.38 with easements plus deed preparation fee and proportionate share of the survey cost as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.

Consultations:

Consultations were held with City Administrative Departments and Utility Companies, which resulted in the information found in attached Appendix ‘C’.

The Public Works – Engineering division objected to the proposed closure on the grounds that there are municipal sewers and a manhole within the proposed closure.
