1) Dwelling Units in a Combined Use Building with any one or more of the uses permitted in section 14.12.1 of By-law 8600; provided that
-
all dwelling units, not including entrances thereto, shall be located above the non-residential uses;
-
the provisions in section 14.12.1 shall apply, exclusive of maximum building height, and
-
a maximum building height of 16m shall apply;
2) A stand-alone multiple dwelling, subject to the provisions under section 12.1.5 of Bylaw 8600 and the following provisions:
i. a multiple dwelling with 80 or more units shall be permitted to have one of each of the following uses: convenience store; business office; day nursery; medical office; personal service shop; provided that:
-
the use of an exterior window for the display of goods, services or advertising is prohibited;
-
each use is accessible only from the interior of the building. Direct access from the exterior is prohibited; and
-
the maximum gross floor area of each use or combination thereof shall be 100.0 square metres;
ii. the provisions in section 14.12.1, exclusive of maximum building height, shall also apply to any stand-alone multiple dwelling; [ZDM 13; ZNG/6074]”

Background:
The lands the applicant is seeking to rezone are subject of an Ontario Municipal Board (OMB) decision issued July 10, 2008, OMB Decision No. PL050845; OMB File No. Z050118. The OMB decision led to the change in zoning for Part 7, 12R-23594 and Block 197, 12M-355 from HRD1.4 to CD1.12 (neighbourhood commercial zoning) and Parts 1 & 2, 12R-23594 from HRD1.4 to RD1.1. Other lands, not subject to this rezoning, designated as Parts 3, 4, 5 & 6, 12R-23594 were also included in the OMB decision and were changed from HRD1.4 to RD1.1.
The issue of changing Parts 1 to 7, 12R-23594 and Block 197, 12M-355 to a neighbourhood commercial zoning category was appealed by nearby residents and the appeal was allowed in part by the OMB decision PL050845. A copy of the OMB decision is attached to this report for your perusal.
