developments. Our analysis suggests that the proposed development is in conformity with the following secƟons of the Official Plan:

Section 3.2.2, relating to a vibrant economy; Section 4.2.6, relating to economic opportunity; Section 6.4, relating to employment;

Section 6.4.3, relating to industrial policies; and

Section 7.2.2, relating to general policies for the transportation system.
These policies are included in Appendix B and will be referenced throughout the remainder of this report.

3.3 Zoning By-Law
The subject site is currently zoned Manufacturing District 2.1 in the City of Windsor Zoning By-law 8600, as amended. The existing use on the subject site is listed as a permiƩed use under the current zoning, however the use must be established on the subject site through Site Plan Control.
The subject site has been utilized as a transport terminal for a number of years. The applicant is requesting relief from Interim Control By-law 78-2019 to permit the existing transport terminal to continue on the subject site. Relief is necessary as the Interim Control By-Law 78-2019, which came into effect June 3, 2019, restricts transport terminals in the Manufacturing Districts 1 and 2 for a period of one year. The applicant has begun the Site Plan Control approval process and is proceeding through the necessary steps to obtain the Site Plan Control approval and formalize the use on the site.
The zoning provisions are included in Appendix C– City of Windsor Zoning By-law 8600 Policies and Figure 3.0 - Existing Zoning Designations and will be referenced throughout the remainder of this report.

3.4 Planning Analysis and Considerations
Municipalities in Ontario are required under Section 3 of the Planning Act to ensure that planning maƩers and decisions are consistent with the Provincial Policy Statement (PPS). The PPS includes policies designed to build strong and healthy communities and are intended to direct efficient and resilient development and land use paƩerns. According to the PPS, healthy, livable and safe communities are sustained by: promoting efficient development and land use paƩerns, accommodating a range and mix of housing, commercial, industrial and other uses, avoiding development and land use paƩerns which cause environmental or public health and safety concerns, and promote cost effective development paƩerns to minimize land consumption and servicing costs (PPS, 1.1.1 (a)(b)(c)(e)).
The existing development is a transport terminal for the storage of transport truck trailers. Located adjacent to existing industrial uses (to the west and south west), and commercial uses (to the east and south), the current operation of the subject site promotes employment opportunities, efficient land use paƩerns, efficient use of existing services, and efficient use of nearby major roadways and highways for a freight-intensive land use.
