BY-LAW NUMBER 116-2020

A BY-LAW TO PROVIDE THAT PART-LOT CONTROL SHALL NOT APPLY TO CERTAIN LAND THAT IS WITHIN PLAN OF SUBDIVISION 12M-631 IN THE CITY OF WINDSOR

Passed the 4th day of August, 2020.

WHEREAS the Planning Act, R.S.O. 1990, Chapter P.13, as amended, provides that part-lot control shall apply where land is within a plan of subdivision registered before or after the coming into force of the Act.

AND WHEREAS subsection 7 of Section 50 of the said Planning Act provides that the council of a municipality may by by-law provide that part-lot control does not apply to land that is within such registered plan or plans of subdivision or parts thereof as is or are designated in the by-law and where the by-law is passed part-lot control as described in subsection 5 of Section 50, ceases to apply to such land.

AND WHEREAS it is deemed desirable that the provisions of the said subsection 5 of Section 50 of the Planning Act shall not apply to certain land that is within PLAN OF SUBDIVISION 12M-631 in the City of Windsor.

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. That the provisions of subsection 5 of Section 50 of the Planning Act, R.S.O. 1990, Chapter P.13, do not apply to that part of the land that is within PLAN OF SUBDIVISION 12M-631, as described in Schedule "A" attached hereto and forming part of this by-law.

2. This by-law is repealed on August 4, 2023.

3. This by-law shall come into force and take effect after the final passing thereof.
