City was on the call. At the 17-minute mark, the Tribunal contacted the Claimant’s counsel to understand if he intended to participate in this TCC. At that point, Claimant’s counsel called in to participate in the TCC.

[11] The Tribunal was advised that the anticipated discussion and resolution, indicated in June 2020, had not yet occurred. Claimant’s counsel repeated that he had instructions regarding a possible settlement. The Tribunal was then assured that both counsels were available to have the discussion by the close of business on Friday, September 25, 2020, and that this discussion would definitely take place.

[12] Recognizing that the City would likely wish to consider any possible settlement, the Tribunal directs the parties to advise the Tribunal not later than Thursday, October 15, 2020, whether this matter has settled or whether it will go to a disputed hearing.

[13] If the Tribunal is advised on October 15, 2020 that there continues to be no settlement, the parties are directed to file on that same date the specific steps they propose to undertake to bring this matter to readiness for a hearing.
