GC 5.03     REJECTED MATERIAL

Rejected Material shall be removed from the work site expeditiously after the notification to that effect from the Engineer. Where the Contractor fails to comply with such notice the Engineer may cause the rejected Material to be removed from the site and disposed of in what the Engineer considers to be the most appropriate manner and the Contractor shall pay the costs of disposal and the appropriate overhead charges.

GC 6 INSURANCE, PROTECTION AND DAMAGE

GC 6.01 PROTECTION OF WORK, PERSONS AND PROPERTY

  1. The Contractor, the Contractor’s agents and all workers employed by or under the control of the Contractor, including sub-contractors shall protect the work, structures, utilities, persons and property from damage or injury. The Contractor shall indemnify, and keep indemnified, the Corporation against all claims for injuries or damages to any such person, property, structure, utilities, etc.; which may arise out of, or in consequence of, the construction and maintenance of the Works, and against all claims, demands, proceedings, damages, costs, charges and expenses whatsoever, in respect of, or in relation thereto.

  2. From the commencement to the completion of the Works, the Contractor shall take full responsibility for the care thereof, and in case any damage, loss or injury shall happen to the Works, or to any part thereof, from any cause whatsoever, shall at his own cost, repair and make good the same, so that at completion, the Works shall be in good order and condition, and in conformity in every respect with the requirements of the Contract and the Engineer’s instructions. The Contractor shall also be liable for any damage to the work occasioned by him in the course of any operations carried out by him for the purpose of complying with his obligations under Clause 4.21 hereof.
