Dear Mayor Dilkens:
On October 19, 2020, the Windsor City Council (the "Council-) without discussion approved a motion to "support the resolution passed by Detroit Council" in opposition to the Ambassador Bridge's request to the Michigan Department of Transportation to lift the restrictions on Class 3 and Class 8 hazardous materials.
The purpose of this letter is to advise the Council that the Detroit City Council has passed no such resolution. The resolution referred to in the motion is the draft resolution that was provided to the Council by Detroit City Council member Raquel Castafieda-Lopez (the "Draft Resolution"). I have attached it here for reference.
The history of the Draft Resolution is as follows. It was first presented by Cotmcihnember Castafteda-L6pez to the Public Health and Safety Committee of the Detroit City Council (the "Committee") on September 21, 2020. Thereafter, the Committee, in exercising an appropriate level of due diligence, invited representatives of MDOT and the Ambassador Bridge to attend a Committee meeting to discuss the Draft Resolution on October 5, 2020. At that meeting, the MOOT representative, Mr. Tony Kratofil, confirmed that the following statements in the Draft Resolution were inaccurate:
- "the bridge company in May 2020, upon information and belief is seeking to take advantage of a temporary emergency response waiver solely for emergency supplies ..."
- "in 2014 [MDOT1 ruled against permitting hazardous material to be transported across the Ambassador Bridge . . . in particular because the age and design of the structure make it inherently unsafe for such activity, primarily due to the inability of emergency personnel and equipment to reach the scene in the event of a serious accident"
