the Broadway Drain already completed, the report summarized the actual project costs of the drain improvement works to be $3,835,840.17 (including non-recoverable HST).

Two special benefits have been identified as per the report, namely: the inclusion of the steel-lined channel segment for $1,298,404.39 (including non-recoverable HST) assessable to the Bridge Authority/Transport Canada and an increased width for the access bridge that services, and is therefore assessable to 0 Broadway for $75,799.41 (including non-recoverable HST).

The total amount of special benefit assessments on this project amounts to a price of $1,374,203.80.

The remaining project costs are to be assessed as outlet liability towards the lands that contribute flows to the drain. These lands include all of the lands that lie within the drainage boundary of the Broadway Drain as depicted in the attached drawings. As indicated in the drainage report, the WDBA will pick up the entire cost of the project and there will be no cost to the City of Windsor.

Administration recommends that City Council adopt the Provisional By-law to adopt the drainage report entitled, “Broadway Drain Improvements Report – Engineers Report”, dated January 16, 2020 in accordance with Section 45 of the Ontario Drainage Act.

Section 84 of the Drainage Act allows for the abandonment of all or part of drainage works. The benefitting lands have been consolidated are in the process of being redeveloped and serviced by municipal sewers and storm water facilities, and the remnant drain is redundant. Administration recommends that the upper portions of the Broadway and Healy Drains, as shown on attached drawing C-3558, be abandoned.
