Comments received are attached as Appendix F: Consultations to this report. There are no objections to the proposed amendments.

Lay-bys are not permitted for residential applications and will be removed under the Marion Road Municipal project. The owner will also be required to contribute to the City of Windsor’s alley maintenance fund in the amount of $1000.00. Driveways to be constructed as per AS-204, complete with straight flares and no raised curbs within the right-of-way. Redundant curb cuts shall be removed and restored in accordance with City Standards to the satisfaction of the City Engineer. These issues will be addressed in the site plan control process.

Public Notice

The official notice has been advertised in the Windsor Star newspaper as mandated by the Planning Act.

A courtesy notice will be mailed to all properties within 120 m (400 feet) of the subject site, prior to the Development & Heritage Standing Committee meeting.

Conclusion:

The recommended Zoning By-law Amendment proposes an efficient re-use of an existing building and infrastructure, while maintaining consistency with Provincial Policy Statement and conformity with City of Windsor Official Plan constituting good planning.
