BY-LAW NUMBER 60-2020

A BY-LAW TO CLOSE AND STOP UP AND CONVEY THE 3.66 METRE (12 FOOT) WIDE NORTH/SOUTH ALLEY LOCATED WEST OF HENRY FORD CENTRE DRIVE, EAST OF DROUILLARD ROAD, SOUTH OF THE SOUTHERLY LIMIT OF THE PROPERTY MUNICIPALLY KNOWN AS 1168 DROUILLARD ROAD AND NORTH OF DEMING STREET, CITY OF WINDSOR

Passed the 4th day of May, 2020.

WHEREAS it is deemed expedient to close, stop up and convey the 3.66 metre (12 foot) wide north/south alley located west of Henry Ford Centre Drive, east of Drouillard Road, south of the southerly limit of the property municipally known as 1168 Drouillard Road and north of Deming Street, City of Windsor, as more particularly described in Schedule "A" attached hereto;

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. That the 3.66 metre (12 foot) wide north/south alley located west of Henry Ford Centre Drive, east of Drouillard Road, south of the southerly limit of the property municipally known as 1168 Drouillard Road and north of Deming Street, City of Windsor, as more particularly described in Schedule "A" attached hereto and forming party of this by-law, be and the same is hereby closed and stopped up and conveyed as follows to the abutting property owners subject to easements as noted in s. 3 below.

2. That the required easements pursuant to Council Resolution CR690/2016 be registered over Parts 2 to 15, inclusive, Plan 12R27184 in favour of Bell Canada, Cogeco Canada LP and Enwin Utilities Ltd.

3. That the lands described in section 2 herein be conveyed to the abutting owners at the following conveyance price:

a) For the portion or the subject alley abutting the lands zoned as RD2.1 and RD2.2, $1.00 plus deed preparation fee and proportionate share of the survey costs as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.

4. That the Chief Administrative Officer and City Clerk be authorized and directed to execute on behalf of The Corporation of the City of Windsor and to seal with the seal thereof, any and all documents necessary to implement the foregoing; and that the transaction be completed electronically, for property where it is available, pursuant to By-law Number 366-2003, as amended from time to time.
