A BY-LAW TO CLOSE AND STOP UP TO BE RETAINED BY THE CORPORATION OF THE CITY OF WINDSOR FOR MUNICIPAL PURPOSES THE 3.048 METRE (10 FOOT) WIDE EAST/WEST ALLEY LOCATED WEST OF HENRY FORD CENTRE DRIVE, EAST OF DROUILLARD ROAD, SOUTH OF THE SOUTHERLY LIMIT OF THE PROPERTY MUNICIPALLY KNOWN AS 1168 DROUILLARD ROAD AND THE NORTH OF DEMING STREET; CITY OF WINDSOR
Passed the 4th day of May, 2020.
WHEREAS it is deemed expedient to close and stop up to be retained by The Corporation of the City of the 3.048 metre (10 foot) wide east/west alley located west of Henry Ford Centre Drive, east of Drouillard Road, south of the southerly limit of the property municipally known as 1168 Drouillard Road and north of Deming Street, City of Windsor, as more particularly described in Schedule "A" attached hereto;
THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:
1. That the 3.048 metre (10 foot) wide east/west alley located west of Henry Ford Centre Drive, east of Drouillard Road, south of the southerly limit of the property municipally known as 1168 Drouillard Road and north of Deming Street, City of Windsor, as more particularly described in Schedule "A" attached hereto and forming part of this by-law, be and the same is hereby closed and stopped up and retained by The Corporation of the City of Windsor for municipal purposes, subject to easements as noted in s. 3 below.
2. That the required easements pursuant to Council Resolution CR690/2016 be registered over Part 1 on Plan 12R27925 in favour of Bell Canada, Cogeco Cable Canada LP and Enwin Utilities Ltd.
3. That the Chief Administrative Officer and City Clerk be authorized and directed to execute on behalf of The Corporation of the City of Windsor and to seal with the seal thereof, any and all documents necessary to implement the foregoing; and that the transaction be completed electronically, for property where it is available, pursuant to By-law Number 366-2003, as amended from time to time.
4. This by-law shall come into force and take effect the day upon which it is registered in the Land Registry Office for the County of Essex (No. 12).
