BY-LAW NUMBER 55-2020

A BY-LAW TO EXTEND THE PERIOD OF TIME DURING WHICH INTERIM CONTROL BY-LAW 78-2019 WILL BE IN EFFECT, BY ONE ADDITIONAL YEAR, TO JUNE 2, 2021

Passed the 27th day of April, 2020.

WHEREAS on June 3, 2019, the Council of the Corporation of the City of Windsor enacted Interim Control By-law 78-2019 to prohibit the use on all lands, buildings, and structures for a Transport Terminal other than those lawfully being carried out on the day of passage of this Interim Control By-law, within the areas designated as Manufacturing Districts 1. and Manufacturing Districts 2. in Zoning By-law 8600 and Industrial Zone (M1) in Zoning By-law 85-18 of the City of Windsor for a period of one year.

AND WHEREAS Section 38(2) of the Planning Act, R.S.O. 1990, Chapter p. 13, provides Council with the discretion to extend the period of time during with Interim Control By-law 78-2019 will be in effect, provided the total period of time does not exceed two years from the date of the passing of Interim Control By-law 78-2019.

AND WHEREAS the Transport Terminal Study is advancing, additional time is required to complete the Study and, if deemed appropriate, implement the findings of the Study including any amendments to the Official Plan and/or Zoning By-laws.

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. Interim Control By-law 78-2019, as amended, is hereby further amended by repealing Section 5 and replacing it with the following:

“5. This By-law shall come into force and take effect immediately upon passage thereof, and shall be in effect until June 2, 2021, unless repealed by Council at an earlier date.”
