A BY-LAW TO CLOSE, STOP UP AND CONVEY THE 4.57 METRE EAST/WEST ALLEY LOCATED NORTH OF ARMANDA STREET, SOUTH OR JOYCE STREET, EAST OF WATERLOO AVENUE AND WEST OF WERNER AVENUE, CITY OF WINDSOR

Passed the 27th day of April, 2020.

WHEREAS it is deemed expedient to close, stop up and the 4.57 metre wide east/west alley located north of Armanda Street, south of Joyce Street, east of Waterloo Avenue and west of Werner Avenue, City of Windsor, more particularly described in Schedule "A" attached hereto;

THEREFORE the Council of the Corporation of the City of Windsor enacts as follows:

1. That the 4.57 metre wide east/west alley located north of Armanda Street, south of Joyce Street, east of Waterloo Avenue and west of Werner Avenue, City of Windsor, more particularly described in Schedule “A” attached hereto and forming part of this by-law, be and the same is hereby closed and stopped up.

2. That the conveyance of the closed alley shall be done in the following manner:

a) That the portion of the subject alley described as Parts 5 to 8, a) inclusive, Plan 12R28012, be conveyed to the abutting property owners of each side of the alley. Provided, however, that any such property owner shall notify the Planning Department, in writing, of the owner’s intention to exercise the owner’s right to purchase, if such owner does not exercise its right of first refusal to purchase, the Planning Department shall be authorized to offer that part to the other abutting property owner at the same price.

b) That the portion of the subject alley described as Parts 1 to 4, b) inclusive, and Part 9, Plan 12R28012, be conveyed to the abutting property owners fronting of Armanda Street.

3. That the lands abutting properties described above in section 2(a) and (b) and zoned as RD1.1 be conveyed as follows:

a) $1.00 plus deed preparation fee and proportionate share of the survey cost as invoiced to The Corporation of the City of Windsor by an Ontario Land Surveyor.
