That the Chief Administrative Officer and City Clerk BE AUTHORIZED to sign the construction contract based on the tendering results pursuant to Recommendation I and II, subject to the amount being within the project budget, satisfactory in form to the City Solicitor, in financial content to the Chief Financial Officer and City Treasurer and in technical content to the City Engineer. All costs to be charged to Project ID # 7141019, Little River Steel Retaining Walls.
The procurement process for retaining a consultant was undertaken as RFP 29-2019. As the conditions of Council Resolution 352/2019 were satisfied, R.C. Spencer Associates Inc. was selected as the proponent, at a cost of $247,900 + HST.
Discussion:
The powers vested to the Drainage Engineer in the Drainage Act are required in order for R.C. Spencer Associates Inc. to complete the requisitioned work.
R.C. Spencer Associates Inc. will begin their work in May 2020. In the meantime, residents have been notified of the pending topographic survey.
Risk Analysis:
Adoption of the recommendation ensures that the successful proponent is able to carry out necessary duties. Absent adoption of the recommendation, the right to enter private property can be overcome by having the Drainage Superintendent on site. The consequence of this outcome is that it fully encumbers the work day of the Drainage Superintendent to this particular project rather than to other assigned duties.

There are no financial consequences arising from this recommendation.

In order to efficiently undertake the work authorized by CR352/2019, the designation of R.C. Spencer Associates Inc. as Drainage Engineer under the Drainage Act is recommended.
