Conclusion:

A by-law to require flood abatement measures could be established either in a new bylaw under the provisions of the Municipal Act or through provisions of the BCA by adding an amendment to the Property Standards By-law 9-2019. However as noted in this report a traditional by-law with standards to be enforced will be extremely challenging if not impossible without established standards to justify legislated abatement measures. Therefore, for the reasons noted in the Risk Analysis section, the same is not recommended.

Should Council wish to implement any such measures, consideration of the use of the local improvement regulation for voluntary flood abatement measures on private property is suggested as the preferable option.
