- The first building east of the subject area of closure is a single unit dwelling owned by Cesare Enterprise Inc. (original applicant), and municipally known as 613 Havens Drive.
- Bell Canada pedestal, sanitary sewer, light standards, manhole and Canada Post mailboxes are located outside of the northern limit of the subject area of closure.
- Enwin Utilities Ltd. will require an easement for the underground hydro distribution along the northerly limit on the westerly portion of the subject area of closure as shown in Diagram 1 found in the attached Appendix C.
- There are curbs and gutter along this section of Havens Drive, but there is no driveway approach in the requested area of closure.
The subject land is zoned Residential District 1.1 with a Holding Symbol (HRD1.1) by Zoning By-law 8600. The removal of the holding symbol will be necessary to allow for the development of the subject area of closure. Administration (Legal Department Staff) will undertake the process for removal of the holding symbol prior to listing the property for sale. RD1.1 zoning permits the following uses per building lot: One single-unit dwelling; an existing duplex dwelling or existing semi-detached dwelling; and any use accessory to the foregoing uses.
The minimum lot size for each building lot in the RD1.1 Zoning District is 15 metres (minimum lot width) and 450 square metres (minimum lot area). The entire area of closure shown as Parts 1 & 2 on Drawing No. CC-1742 (attached as Appendix A) is approximately 912 square metres in land area. The area of closure shown as PART 1 is approximately 900 square metres in land area, which meets the required minimum lot area for two building lots in the RD1.1 zoning category. However, due to the irregular shape of PART 1, sufficient space for rear and front yard setbacks on 2 separate lots cannot be achieved. In addition, the Canada Post mailboxes along the frontage of the subject land require protection and a 0.3m (1-foot) land reserve is recommended (see PART 2 on Drawing No. CC-1742). The land reserve limits driveway access along the westerly frontage of the subject land. For the above reasons, only one building lot is considered appropriate on the subject area of closure shown as PART1.
Risk Analysis:
The recommended closure is necessary to facilitate the sale of the subject land (PART 1 of the area of closure) for a building lot, which will divest the City of associated liability risks and maintenance costs. The recommended closure poses no known risk to The Corporation of the City of Windsor.
Financial Matters:
Real Estate Services intends to sell this lot as a residential building lot. Once approval is obtained, an independent appraisal of the lands will be ordered in order to ascertain market value for the lands.
