As noted by Engineering Division of Public Works Department (see Appendix "C" attached), "Titcombe Municipal Drain runs across the alley, an access easement is required to access the drain and a 15m maintenance easement is required on each side of the drain".
Bell Canada has requested an easement in the subject area of closure.
Notices of the meetings of the Development & Heritage Standing Committee and Council are published in the Windsor Star prior to each of the meetings. In addition, notice of each of the public meetings will be mailed to the abutting/affected property owners prior to the meetings.
Conclusion:
The Planning Division recommends closure of the portion of the east/west alley shown on attached Appendix "A", subject to easements as in Recommendation II of this report, in favour of Bell Canada.
The closed portion is to be conveyed to the abutting property owners as in Recommendation II of this report.
