demolition or removal of the building or structure unless the owner gives the council of the municipality at least 60 days notice in writing of the owner's intention to demolish or remove the building or structure or to permit the demolition or removal of the building or structure."

During the 60 days after notice, City Council (with Committee consultation) may initiate designation, or decide to take no action. If a property is proposed for designation, a notice of intent to designate must include a statement explaining the cultural heritage value or interest of the property and a description of the heritage attributes of the property, which are those features that are considered important to retain if any alterations to the property are proposed after designation. "Cultural heritage value or interest" is to be considered according to Ontario Regulation 9/06.

There is no explicit provision for the Committee or Council to comment on additions to or remodelling a heritage-listed, non-designated property, other than removal from the Register under the Ontario Heritage Act. There is also no explicit provision for approval of demolition subject to stated conditions.

Heritage designation is not being considered at this time and is not part of this report.

Heritage Considerations:

The garage to be demolished appears to have similar heritage/architectural style as the rest of the property and enhances the property's heritage value. After a site visit by administration in May 2019, further information was requested of the owner to justify demolition or explore retention options. A report prepared by GS Engineering Consultants on behalf of the owner has been received and reviewed by Planning and Building staff (Appendix B). This report identifies concerns with framing and foundation issues, and calls into question the structural stability of the garage. According to the report, the brick on the front facade "is in a poor condition" and the existing slab-ongrade "needs to be replaced with a full foundation." The proposed replacement garage will be clad with brick and stucco on the front facade in a similar style to the original, with vinyl siding on the less visible facades on the side and rear. The incorporation of the original materials and form on the front facing facade is an acceptable replacement option for the garage given its inconspicuous location from Victoria Avenue streetview. The general reconstruction of the original design is encouraged but not a requirement of this heritage process.

Official Plan Policy:

The Windsor Official Plan includes (9.0) "A community's identity and civic pride is rooted in physical and cultural links to its past. In order to celebrate Windsor's rich history, Council is committed to recognizing, conserving and enhancing heritage resources."

Objectives include (9.3.2.1) "Council will identify Windsor's heritage resources by: ... (c) Researching and documenting the history and architectural and contextual merit of potential heritage resources on an individual property basis; … 9.3.3.4.(a) maintaining
